General Terms and Conditions of Service

Dear User, before browsing the site and using our services, please carefully read the following General Terms and Conditions. Accessing, browsing and using the site implies express acceptance of these Terms and the user's obligation to comply with them.

The Privacy Policy is to be considered an integral part of these General Terms and Conditions.

The company provides chauffeured car hire (NCC) services for the transfer of passengers to and from major cities, airports, ports and tourist destinations in south-east Sicily.

2. Definitions

In these General Conditions, the following terms have the meanings indicated and are to be interpreted in the singular or plural as the context requires:

"Owner" or "Transfer Pozzallo": the entity identified in Article 1.

"Customer": the natural or legal person who requests the provision of services for themselves or for the Passenger. Unless otherwise stated, the Customer also acts as Passenger.

"Passenger": the person who actually uses the transport service. The Passenger may or may not be the same as the Customer.

"Platform": the online portal accessible at transferpozzallo.it.

"Services": the chauffeured transport services offered by Transfer Pozzallo.

"Booking": the service request submitted by the Customer through the Platform.

"General Conditions": this contractual document governing the relationship between the Parties. This distance contract is governed, inter alia, by Italian Legislative Decree No. 70 of 9 April 2003 on electronic commerce.

3. Subject of the Contract and Services Offered

Transfer Pozzallo offers Customers, upon request, chauffeured car hire (NCC) services in accordance with current Italian legislation (Law No. 21/1992 and subsequent amendments). The service consists of transporting the Customer to the indicated destination, with professional drivers duly registered in the Professional Register at the competent Chambers of Commerce and in possession of all required qualifications and valid operating documents.

Services include, but are not limited to:

- Airport transfers (Catania-Fontanarossa, Comiso, Palermo)
- City-to-city transfers (Catania, Syracuse, Ragusa, Modica and others)
- Transfers to and from Pozzallo port (connections with the ferries to and from Malta)
- Transfers to the Baroque towns (Noto, Modica, Ragusa, Scicli, Syracuse)
- Transfers to tourist destinations (Taormina, Syracuse, Agrigento)
- Long-distance transfers (Palermo and the other side of the island)

Vehicles can accommodate up to a maximum of 8 passengers.

The obligation of Transfer Pozzallo in providing the Services is an obligation of means and not of result.

4. Use of the Platform

By using the Platform, the user agrees to:

- use it exclusively for lawful purposes;
- not make false or fraudulent requests; where there are reasonable grounds to believe that requests are of this nature, the Owner reserves the right to cancel them and inform the competent authorities;
- provide data correctly and truthfully;
- read and accept these Terms and Conditions and the Privacy Policy before making a booking.

If information is not provided in full, it will not be possible to process the request.

5. Access to the Service

By accessing and/or using the Platform, the Customer declares that they have the legal capacity to act in accordance with applicable legislation and have reached the legal age of 18 years. A minor Customer may not use the Service except through a parent or legal guardian.

6. Booking and Conclusion of Contract

In accordance with Italian Legislative Decree No. 70 of 9 April 2003, Transfer Pozzallo informs Customers that:

- the contract between Transfer Pozzallo and the Customer is concluded via the Internet;
- the Customer, by accessing the Platform and following the indicated procedures, can formalise their Booking;
- the Booking may be corrected, modified or cancelled up to the time of its submission;
- once sent, the Booking will be evaluated by Transfer Pozzallo, which reserves the right to accept or reject it.

By submitting the Booking, the Customer declares that they have read and fully accepted these General Conditions and the Privacy Policy, and expressly acknowledges the obligation to pay the price and other amounts due.

After submitting the Booking, the Customer will receive a confirmation email containing the booking details. The Customer undertakes to verify the accuracy of the data and to promptly report any corrections.

As the Booking represents a proposal for requesting the Services, the contract is only considered concluded upon confirmation by Transfer Pozzallo.

Transfer Pozzallo reserves the right to refuse Bookings at its own discretion, including in the following cases: inability to provide the Services due to errors in the information provided by the Customer; technical errors on the Platform; Customers with whom a legal dispute is ongoing; Customers who have provided false, incomplete or inaccurate data.

Pursuant to Article 12 of Legislative Decree 70/2003, each Booking is stored in digital or paper format, ensuring confidentiality and security. The Customer may request a copy by writing to taximodica@gmail.com.

7. Service Execution

Following Booking confirmation, Transfer Pozzallo will send the Customer an email containing:

- acceptance of the transport request and confirmation of the Contract;
- the service itinerary (departure point, destination, time);
- the cost of the service;
- the payment method.

Travel times and journey durations are entirely indicative. Transfer Pozzallo cannot be held responsible for any delays caused by, including but not limited to, weather and traffic conditions.

The driver reserves the right to refuse the trip if the passenger does not respect vehicle behaviour rules, or if the driver believes that the Customer or passenger is using the Services illegally or for unlawful purposes.

8. Prices

Transport service prices shown on the Platform are in EUR and include VAT where applicable.

Prices are not fixed and may vary depending on various factors, including: date, departure and/or arrival location, type of service requested, any additional services, time and distance of the journey. By using the Platform and entering transport details during the Booking process, the Customer actively participates in determining the final price.

9. Payments

The Customer undertakes to pay the price of booked transport services in accordance with the terms established in these General Conditions. Payment may only be made by one of the methods indicated on the Platform:

Cash: the Customer may make payment in cash directly to the driver before using the transport service.

Tax receipts and/or invoices for the transport services will be issued by Transfer Pozzallo.

10. Cancellations, Changes and Refunds

Cancellations

The Customer acknowledges that the right of withdrawal provided by the Italian Consumer Code does not apply to the transport services provided, as these are services related to leisure activities with a specific date or period of performance.

However, the Customer may cancel the Booking under the following conditions:

- Cancellation is possible without penalty if made at least 48 hours before the scheduled start date of the transport service.
- If cancellation is requested less than 48 hours before the scheduled service date, the Customer shall not be entitled to any refund.

To request a cancellation, the Customer must send a communication to taximodica@gmail.com or by calling +39 333 230 5022.

Changes

The Customer may request changes to the Booking under the following conditions:

- Changes more than 48 hours before the service: possible without penalty, subject to payment of any price differences.
- Changes within 48 hours of the service: subject to availability and possible surcharges. If the originally booked vehicle is unavailable, the service may be performed with a different vehicle.

Changes are only valid if confirmed in writing and include the new applicable fare. To request a change, contact taximodica@gmail.com.

Refunds

If the Customer/Passenger fails to arrive at the place and time set for the start of the service (no-show), they shall not be entitled to any refund, even if the non-show is due to circumstances beyond the Customer's control (such as flight or train delays). In such situations, the Customer is invited to request reimbursement directly from the airline or railway company responsible.

Cancellation by Transfer Pozzallo

In the event of unavailability of the Services, Transfer Pozzallo will not charge the Customer any costs. If payment has already been made, a refund of the corresponding amount will be issued.

Transfer Pozzallo reserves the right to cancel Bookings from Customers who have provided false, incomplete or inaccurate identification or service data.

11. Luggage

Each passenger is authorised to carry:

- 1 standard-sized hold luggage
- 1 piece of hand luggage

Any excess luggage or bulky equipment (e.g., ski equipment) must be declared at the time of booking to ensure the vehicle is suitable. Transfer Pozzallo reserves the right to charge a surcharge if a larger vehicle is needed.

The driver may refuse to load undeclared bulky items or luggage unsuitable for transport conditions if they could compromise journey safety.

Passengers' property is transported under their sole responsibility. Transfer Pozzallo and the driver are not liable for theft, damage or loss of luggage.

12. Carriage of Children

If one or more passengers are children, the Customer must request the necessary equipment (child seats or booster seats) during the booking process. This equipment will be provided for a fee. If not requested, Transfer Pozzallo shall not be obliged to provide such equipment and shall not be liable for any damages suffered.

13. Carriage of Animals

If the Customer requires the transport of animals, where permitted by applicable law, they must indicate this during the booking process and/or contact Transfer Pozzallo before completing the booking. A suitable pet carrier must be provided. Without these conditions being met, Transfer Pozzallo shall not be obliged to provide the service and shall not be liable for any damages.

14. Customer Behaviour During Service

During the service, the following is prohibited:

- smoking inside the vehicle;
- throwing objects from the vehicle, whether stationary or in motion;
- defacing, soiling or damaging the vehicle;
- consuming food and/or alcoholic beverages;
- transporting pets without having taken necessary precautions in agreement with the Owner;
- demanding that transport take place in violation of safety regulations and the Highway Code.

In the event of violation of these rules or inappropriate behaviour, Transfer Pozzallo reserves the right to claim compensation for vehicle damage or extraordinary cleaning required.

15. Insurance

Vehicles used for the service are fully insured in compliance with current Italian and European Union regulations. Passenger transport is covered by the insurance policy taken out for NCC vehicles.

The company's liability is limited to the maximum amount of the policy. The company shall not be liable for loss or damage to goods transported by the Customer in the event of force majeure, inherent defects in the goods or errors by the Customer.

16. Driver Absence

In the event that the driver fails to appear, the passenger must contact the driver at the phone number provided. If the driver cannot be reached, the passenger must immediately contact customer service at +39 333 230 5022. Should the passenger fail to contact customer service within 15 minutes of the scheduled time, Transfer Pozzallo shall not be held liable for any consequences.

17. Intellectual Property

The Platform domain name and all its constituent elements (photographs, texts, videos, logos, graphics) are the exclusive property of Transfer Pozzallo and are protected under industrial property and copyright law. Any total or partial reproduction is strictly prohibited without prior written consent.

18. Lost Property

In case of loss of personal items inside the vehicles, the passenger may report it by sending an email to taximodica@gmail.com. The Customer is responsible for any transport and delivery costs. Non-perishable items will be stored for 3 months, after which they will be donated to charity. Perishable items will be disposed of at their expiry date.

19. Force Majeure

Transfer Pozzallo shall not be held liable for any breach of contractual obligations in the event of force majeure or unforeseen events, including but not limited to: acts of war or terrorism, strikes, national or local emergencies, transport infrastructure malfunctions, power cuts or other essential service disruptions, earthquakes and other natural disasters.

20. Duration of Contract

The Contract is deemed concluded upon the occurrence of one of the following events:

- completion of the transport service;
- communication by Transfer Pozzallo of the non-conclusion of the Contract.

In the event of termination with a right to reimbursement, Transfer Pozzallo will refund the Customer using the same payment method used for purchase, unless otherwise agreed.

21. Termination

The Contract shall be terminated by right pursuant to Article 1456 of the Italian Civil Code in the following cases:

- non-payment, even partial, of the amount due;
- failure of the passenger to appear at the agreed pickup point within the free waiting period of 20 minutes from the scheduled time, without having cancelled the booking or communicated delays, and without being reachable at the provided phone number.

22. Privacy and Cookie Policy

To understand the processing of personal data on the Platform, please consult the Privacy Policy. For information about cookies, please refer to the relevant section in our Privacy Policy.

23. Applicable Law and Jurisdiction

For all matters not expressly provided for in these General Conditions, reference is made to the provisions of the Italian Civil Code and current regulations. If the Customer qualifies as a "consumer" under Italian Legislative Decree 206/2005 (Consumer Code), the relevant provisions shall apply, except for those concerning distance contracts for leisure-related services.

Pursuant to Article 14 of Regulation (EU) No. 524/2013, consumers are informed that a European platform for online dispute resolution (ODR platform) is available at: https://ec.europa.eu/consumers/odr/.

Unless otherwise provided by law, the parties undertake to use mediation before initiating any legal proceedings relating to disputes concerning the use of the Platform, the Services or these General Conditions.

Any dispute relating to the execution, interpretation and termination of this agreement shall be submitted to the exclusive jurisdiction of the Court of Ragusa (Foro di Ragusa). However, if the Customer is considered a "consumer" pursuant to the Consumer Code, jurisdiction shall be that of the court of the consumer's place of residence or domicile, if located within Italy.

24. Severability

Should any provision of these General Conditions be declared null, void or ineffective, this shall not affect the validity of the remaining clauses.

26. Amendments

Transfer Pozzallo undertakes to ensure that these General Conditions are always accessible and up to date. These conditions may be modified or updated at any time. The user is required to consult the General Conditions before making any booking. The applicable General Conditions are those in force on the date the Booking is submitted.
